Equipment hire terms & conditions.
PLI
It is the sole responsibility of the hirer to ensure that they have appropriate and sufficient Public Liability Insurance and any other necessary licenses, risk assessments, etc. I am not liable for death, injury or damage caused by equipment that was safe to use at the start of the hire period while in the care of the client. I withhold the right to both requests the hirers PLI cover details and refuse hire without any prior notice or advance warning should I believe that the hirer does not have appropriate cover.
Damage
The hirer is responsible for all equipment during the period of hire, and is therefore liable to cover the cost of replacing or repairing damaged equipment. All equipment is tested before being sent out on hire. By accepting the equipment the hirer confirms that it is in working order. Any damage recorded upon the equipments return is thus the responsibility of the hirer, who will be charged accordingly.
Loss of equipment
The hirer is responsible for the security and care of hire equipment, and is therefore obligated to pay for replacements for any equipment which is lost or stolen. In most cases this means replacing the equipment with brand new items.
Power
It is the responsibilty of the hirer to ensure that the power suplly avaiable at the venue is suitable for the equipment to be used. While hired equipment can be powered from a generator, the hirer does so at their own risk. It is the responsibility of the hirer to make sure that the power supply is capable of supplying the load which is presented to it by the equipment hired, and that supplies suitably repliable and 'clean' AC electricity. It is not my responsibility to supply a means of powering hired equipment unless specifically stated.
PAT and Electrical Safety
All equipment is PAT tested annually, as well as being visually inspected before going out on hire. However, this does not eliminate the need for the hirer to visually inspect equipment prior to each use and use their own judgement should faults be discovered.
Training and Familiarisation/Competent Operators
In some cases equipment may need to be demonstrated to a competent operator before it can be placed in the care of the hirer. If the operator is not deemed to be sufficiently competent, trained or qualified then I, or an agent working on my behalf, has the right to both request the details of the operator and/or refuse or cancel a hire, without notice, should the operator be deemed to be insufficiently competent to operate the equipmenet safetly. It is still primarily the responsibility of the hirer to ensure that equipment is used safely by competent personell and as such are liable should death, injury or damage be caused by hired equipment used by operators who are not working on my behalf.
Returning Equipment
Equipment should be returned in it's original state. All labels, etc. should be removed with all mixing consoles and outboard being zeroed. All equipment should be packaged correctly. Failure to return equipment in this way will result in the client being charged £14 per man hour spend returning the equipment to it's proper state.
